By accessing or using BinaryTick, the browser-based trading platform at app.binarytick.com and the website at binarytick.com (together, "the Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Platform.
These Terms constitute a legally binding agreement between you and BinaryTick ("we", "us", or "our").
BinaryTick is an independent, third-party web application that provides a trading interface for accessing the Deriv trading platform via Deriv's publicly available API. It runs in your web browser, with nothing to download or install. BinaryTick is not a broker, exchange, or financial institution.
The Platform provides two ways to trade: placing contracts yourself, and running automated strategies ("bots"). Section 6 governs the use of bots.
BinaryTick is not affiliated with, endorsed by, or officially connected to Deriv in any way.
By using this Platform, you are also subject to Deriv's own Terms & Conditions, available at deriv.com/terms-and-conditions. In the event of any conflict between these Terms and Deriv's Terms, Deriv's Terms shall prevail with respect to your trading activity.

The Platform is free to use. There is no subscription, and no charge for any bot or strategy on it. BinaryTick earns revenue in two ways:
This section governs the ready-made strategies, the block editor, and any strategy you import. Read it before you run a bot.
Once started, a bot places, and where applicable sells, real contracts on your account automatically, using the settings you gave it. It does not ask you to confirm individual trades. Starting a bot on a real-money account authorises every trade it goes on to make.
You alone decide which strategy to run, on which market, with what stake, and on which account. You are responsible for the outcome of every trade a bot places on your account, including trades placed while you are not watching.
The strategies included with the Platform are provided as working starting points. They are not trading advice, investment recommendations, or an assertion that they are profitable. Any description of how a strategy behaves, including any hit rate or win rate, describes its mechanics and is not a prediction of results. No strategy can guarantee a profit, and any claim to the contrary should be treated as false.
Some strategies include a martingale multiplier or similar setting that increases the stake after a losing trade. Settings of this kind can grow your stake very quickly across a run of losses and can lose an account balance far faster than flat staking. You are responsible for understanding a setting before you enable it, and for setting a maximum stake, stop loss, and take profit that you are willing to accept.
Every account starts on a demo balance of virtual funds. We strongly recommend running any strategy on demo, including one you have edited or imported, until you understand how it behaves before you run it with real money.
Bots run in your browser, not on our servers. A bot stops if you close the tab or browser, if your device sleeps, or if your internet connection drops. A bot may also stop or fail to place a trade because of Deriv API errors, rate limits, market suspensions, or contract unavailability.
A stopped bot does not close your open positions. Any contracts already running continue to their own expiry under Deriv's terms. You are responsible for monitoring your account and your open positions. Do not assume a bot is still running because you left it running.
You may import your own strategy as an XML file. Imported files are loaded and stored in your own browser. You are responsible for the contents, safety, and behaviour of any strategy you import, and for having the right to use it. Do not import a strategy from a source you do not trust. We do not review, validate, endorse, or take responsibility for imported strategies.

For the avoidance of doubt, running, editing, and importing trading bots through the Platform's own bot features is a normal and intended use, and nothing in this section restricts it.
Violation of these prohibitions may result in immediate termination of your access to the Platform.
The BinaryTick name, logo, design, and all related intellectual property are the exclusive property of BinaryTick. Nothing in these Terms grants you any right, title, or interest in our intellectual property.
You may not copy, reproduce, distribute, or create derivative works based on BinaryTick's branding or content without our express written permission.
Strategies you create or import remain yours. Because they are stored in your own browser, we neither claim nor hold any rights over them.
To the maximum extent permitted by applicable law, BinaryTick and its operators shall not be liable for:
The Platform is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
You agree to indemnify and hold harmless BinaryTick and its operators from any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising from:

We reserve the right to:
When we update these Terms, we will update the "Last updated" date at the top of this document. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms.
We reserve the right to terminate or suspend your access to the Platform at any time, without notice, for any reason including violation of these Terms or suspected fraudulent or illegal activity.
Upon termination, your right to use the Platform ceases immediately. Any data stored in your browser, including saved strategies, remains there until you clear your browser's site data.
Any disputes arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation by contacting us at support@binarytick.com. Since all trading activity is governed by Deriv's own Terms & Conditions, disputes relating to trades, payouts, or account matters should be directed to Deriv directly.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
